Aquarius Luxury Suites is committed to compliance with the Protection of Personal Information Act, No. 4 of 2013 (“POPIA” or “the POPI Act”), which came into full effect on 1 July 2021. This statement outlines how we handle personal information in accordance with the Act's eight conditions for lawful processing.
1. Our Commitment to POPIA Compliance
Aquarius Luxury Suites respects the privacy rights of all individuals whose personal information we process. We are committed to:
- Processing personal information lawfully, fairly, and transparently
- Collecting personal information for specific, explicitly defined, and legitimate purposes
- Limiting the use of personal information to what is adequate, relevant, and not excessive
- Ensuring the accuracy of personal information and keeping it up to date
- Retaining personal information only for as long as necessary
- Implementing appropriate technical and organisational security measures
- Respecting the rights of data subjects as defined in the POPI Act
2. Personal Information We Process
In the course of providing accommodation and related services, Aquarius Luxury Suites may process the following categories of personal information:
- Identity information: full name, identity/passport number
- Contact information: email address, phone number, postal address
- Booking and reservation details: check-in/check-out dates, suite preferences, special requests
- Payment information: credit/debit card details (processed by our secure payment provider)
- Communication records: emails, phone call notes, enquiry forms
- Marketing preferences: newsletter subscriptions and opt-in/opt-out records
- Website usage data: IP address, browser type, pages visited (via cookies and analytics)
3. Purpose of Processing
We process personal information only for the following lawful purposes:
- To process, confirm, and manage accommodation bookings
- To fulfil contractual obligations to guests and enquirers
- To communicate with guests regarding their stay
- To process payments and issue invoices
- To comply with legal obligations, including tax, financial reporting, and security requirements
- To send promotional communications to guests who have consented to receive them
- To improve our services through analysis of aggregated, anonymised data
4. Rights of Data Subjects
Under POPIA, you have the following rights with respect to your personal information held by Aquarius Luxury Suites:
Right to Access
You have the right to request a copy of the personal information we hold about you.
Right to Correction
You have the right to request the correction of inaccurate, irrelevant, excessive, out-of-date, or misleading personal information.
Right to Deletion
You have the right to request the deletion or destruction of your personal information, subject to any overriding legal obligations we may have to retain it.
Right to Object
You have the right to object to the processing of your personal information on reasonable grounds, including for direct marketing purposes.
Right to Complain
You have the right to submit a complaint to the Information Regulator of South Africa if you believe your rights under POPIA have been violated.
5. How to Exercise Your Rights
To exercise any of your rights under POPIA, or to submit a data subject access request, please contact our Information Officer in writing. We will acknowledge your request within 3 business days and respond substantively within 30 days.
